1. Introduction

These Terms and Conditions of Use (“Terms”) apply to your use of the website www.iweiyi.com (the “Website”) and to all orders you place for flowers, cakes, gifts and related products (the “Products”) that we arrange for delivery (the “Services”). The Website and Services are operated by Hydra Internet Limited (“Hydra Internet Limited”, “iweiyi.com”, “we”, “us” or “our”). By using the Website, creating an account or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Website or Services.

2. Definitions

In these Terms:

  • “Customer” / “you” means the person using the Website and/or placing an order.
  • “Recipient” means the person designated to receive the Products.
  • “Order” means a request submitted via the Website for the purchase and delivery of Products.
  • “Products” means flowers, bouquets, plants, cakes, chocolates, fruit baskets, plush toys, preserved flowers, gift boxes and other items offered for sale on the Website.
  • “Services” means the online ordering, payment, customer support and delivery coordination services provided through the Website.
  • “Service Areas” means Mainland China, Hong Kong, Macau and Taiwan in locations where we or our partners can deliver.
  • “Third-Party Service Providers” means florists, bakeries, couriers, logistics providers, payment processors and other external vendors assisting with the Services.

4. Scope of Application

These Terms govern all access to and use of the Website and all Orders placed by Customers worldwide for delivery to Recipients within the Service Areas. Additional terms may apply to specific promotions, gift cards or Product categories; in case of conflict, those specific terms prevail. Your use of any third-party websites or services linked from the Website is governed by their own terms and policies.

5. Eligibility and Account Registration

By using the Website and/or placing an Order, you confirm that you are at least 18 years old or have legal capacity to enter into binding contracts. You may create a customer account (“Account”) to manage Orders and access certain features. You must provide accurate and up-to-date information and keep your login details confidential. You are responsible for all activity under your Account and must notify us promptly of any unauthorised use. We may suspend or close Accounts at our discretion, for example in case of suspected fraud, misuse or security concerns.

6. Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not damage, disable or interfere with the Website or the use of it by others. In particular you must not:

  • use false information or place Orders using unauthorised payment methods;
  • attempt to gain unauthorised access to the Website, servers or related systems;10
  • use automated tools (bots, scrapers or similar) to access or collect data from the Website without our consent;
  • introduce viruses, malware or other harmful code; or
  • misuse promotional offers, vouchers, referral programmes or discount codes contrary to their specific terms.

We may deny or restrict access to the Website or Services for any user who violates these Terms.

7. Ordering Process and Contract Formation

Product listings on the Website are invitations to treat, not binding offers. By submitting an Order and completing payment, you make an offer to purchase the Products in that Order, subject to these Terms.

After you place an Order, you will receive an email acknowledging receipt (“Order Confirmation”). The Order Confirmation confirms that we have received your Order but is not a guarantee of availability. A binding contract arises when we accept your Order for fulfilment. We reserve the right to cancel all or part of an Order, for example where Products are unavailable, we cannot deliver to the address, payment is not authorised or an obvious error exists in pricing or Product information. If we cancel an Order after payment has been received and this is not due to your fault, we will refund the relevant amount and may waive any processing fee referred to in clause 11.

8. Products, Descriptions and Substitutions

We try to ensure that all Product descriptions, specifications and images on the Website are accurate and current. However, minor differences in colour, design, packaging and presentation may occur.

Flowers and many gifts are seasonal and availability varies by date and location. Where necessary, we may substitute flowers, foliage, containers, cakes, chocolates, packaging or other components with items of equal or greater value while maintaining the general style and colour scheme of your selection. For certain branded items, equivalent brands or similar items may be used if the original brand is not available locally. Any dimensions indicated (such as bouquet size or cake diameter) are approximate.

9. Prices, Currency, Taxes and Payment

Unless stated otherwise, prices on the Website are shown in United States Dollars (USD). For convenience we may display approximate prices in other currencies based on indicative exchange rates; such conversions are for reference only. The price payable is the price shown at checkout when you submit your Order, subject to obvious error.

Prices may include applicable local taxes where required by law. Additional charges, such as delivery surcharges to remote areas, will be displayed during checkout when possible. We may change prices and charges at any time but such changes do not affect Orders already accepted.

Payment must be made in full at the time of Order using the methods listed on the Website, which may include major credit and debit cards, Alipay, WeChat Pay, UnionPay and other digital wallets. Payments are processed by secure third-party payment processors. By providing payment details you authorise us and our processors to charge the total Order amount and any agreed additional charges. In case of payment failure or chargeback we may cancel the Order, seek alternative payment and/or refuse future Orders.

10. Delivery Areas, Methods and Timeframes

We arrange delivery of Products to Recipients within the Service Areas, subject to coverage of our local network. Deliveries are made either by hand via local partner florists, bakeries or gift shops, or by third-party courier or express parcel services.

Same-day delivery is generally available for many locations for Orders placed before 6:00 p.m. China Standard Time (GMT+8), subject to Product availability and local capacity. In some cities we may offer an estimated 1–3 hour delivery window from Order acceptance. All delivery times are estimates only and are not guaranteed; traffic, weather, access restrictions, local regulations and public holidays may affect actual delivery times.

For deliveries to hospitals, hotels, offices, schools, gated communities or similar locations, delivery may be made to a reception desk, concierge, security office, colleague or other authorised person. Once accepted by such an intermediary, the Order is treated as delivered and we are not responsible for any subsequent delay in the Recipient receiving the Products.

You are responsible for providing a complete and accurate delivery address and contact number for the Recipient. We are not liable for delay or failure caused by incorrect or incomplete details. If redelivery or rerouting is required, extra charges may apply and we cannot guarantee the freshness of perishable Products. If the Recipient is unavailable, the driver may leave the Products with a neighbour or building staff, leave them in a safe place where reasonable, or attempt to contact you or the Recipient. Where these steps are taken in good faith, the Order will be treated as delivered; additional redelivery attempts may incur extra charges.

11. Cancellations, Refunds and Complaints

You may request to cancel or change an Order by contacting our customer service team. To be eligible for a refund, cancellation requests must reach us at least 24 hours before the scheduled delivery date or time. If your request is received later, or if Products have already been prepared, dispatched or delivered, the Order may not be cancelled and no refund will be issued.

For any refund requested by the Customer, including timely cancellations, a non-refundable processing fee of USD 10 will normally be deducted from the refund amount. This fee contributes to payment gateway charges, administrative handling, currency conversion and order processing costs. The fee applies per Order unless stated otherwise.

If a refund is due because of an issue directly caused by us or our partners—such as an undeliverable but valid address, lack of any suitable substitution, or a confirmed mistake on the Order—we may, at our discretion, waive the USD 10 fee and refund the relevant amount in full or offer an equivalent remedy.

Because many Products are perishable, any concern about quality, freshness or condition must be reported within 48 hours of delivery, together with the Order number, clear photos and a brief description of the issue. We will review each case and may offer a replacement, partial refund, store credit or, in exceptional cases, a full refund. If you contact us after 48 hours, we may be unable to investigate properly or offer a remedy.

Approved refunds are usually processed using the original payment method where technically possible. Processing times depend on your bank, card issuer or payment provider and are outside our control.

12. Promotions, Discount Codes and Gift Cards

From time to time we may offer promotions, discount codes, vouchers or gift cards (“Offers”). Each Offer is subject to its specific conditions, such as validity dates, minimum spend, eligible Products and limits per customer. Unless stated otherwise, Offers have no cash value, cannot be sold or transferred, and only one Offer may be used per Order. We may cancel or adjust any Offer in case of misuse, error or suspected fraud.

13. Personal Messages and User Content

You may include a personal message with your Order. We will print or write this on a card or slip. You are responsible for the content of your message and agree not to submit anything unlawful, offensive, defamatory, discriminatory, threatening or infringing the rights of others. We may refuse to print, or edit or omit, any message we consider inappropriate or contrary to law or these Terms.

If you submit reviews, comments or other user content on the Website or our social media channels, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business, subject to applicable law and our Privacy Policy.

14. Intellectual Property

All text, images, graphics, logos, icons, Product descriptions, downloads and software on the Website (the “Website Content”) are owned by or licensed to Hydra Internet Limited or its content suppliers and are protected by intellectual property laws. You may view the Website Content for your personal, non-commercial use only. You may not copy, modify, distribute, publish, display or create derivative works from the Website Content without our prior written consent. All trademarks and trade names on the Website belong to their respective owners; use of third-party brand names is for identification only and does not imply endorsement.

15. Privacy and Data Protection

We collect and process personal data in accordance with applicable data protection laws. Our Privacy Policy, available on the Website, explains what personal data we collect, how we use and share it, and your rights. By using the Website or placing an Order, you acknowledge that you have read the Privacy Policy and consent to our processing of your data as described there. To fulfil your Order we may share necessary data, such as the Recipient’s name, address and phone number, with our local partners and Third-Party Service Providers.

The Website may contain links to third-party websites, payment pages, apps or services that are not owned or controlled by us. These are provided for convenience only. We do not endorse and are not responsible for the content, products, services or policies of third-party sites, or for any loss arising from your use of them. 17. Limitation of Liability and Force Majeure

Nothing in these Terms excludes or limits any liability that cannot legally be excluded, such as liability for death or personal injury caused by negligence or for fraud. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, business, goodwill or anticipated savings, arising out of or in connection with the Website, the Services or any Order.

Our total liability in respect of any Order, whether in contract, tort (including negligence) or otherwise, is limited to the total amount paid by you for that Order. We are not responsible for delay or failure in performance caused by events beyond our reasonable control, including but not limited to extreme weather, natural disasters, public holidays, strikes, transport or network disruptions, public health emergencies, government actions or other force majeure events.

18. Governing Law, Changes and Miscellaneous

These Terms and any dispute arising out of or in connection with them or with any Order are governed by the laws of Hong Kong SAR, without regard to conflict of law rules. The courts of Hong Kong SAR have exclusive jurisdiction over any such dispute, subject to any mandatory consumer protections that may apply under the law of your country of residence.

We may update these Terms from time to time. The date at the top of this page shows when they were last revised. If you continue to use the Website or place Orders after changes take effect, you are deemed to accept the updated Terms.

These Terms, together with any additional terms referred to in them and our Privacy Policy (and Cookie Policy where applicable), form the entire agreement between you and us regarding the use of the Website and the Services. If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force. Our failure to exercise any right does not constitute a waiver. You may not assign your rights or obligations under these Terms without our consent; we may assign our rights and obligations in connection with a reorganisation, merger or sale of business, provided this does not materially reduce your rights.
